state collecting on estate from Nursing home fees

We have owned my mother in laws house for 22 years but my husband left her name on the deed because we let her continue to live in the house until 2005 when she entered a nursing home on medicaid and we removed her from the deed. Now the state wants to collect on 50% of the estate since she passed away. Do we have any claim on the whole house since we have owned it for so long or is it a lost cause and not worth fighting the state of Utah? What steps should we take? We certainly can't afford to pay them without selling and the estate is not worth a great deal.

This question is very fact specific. Generally the state has a claim on the listed assets of the patient. However there are exceptions. I have had similar cases which worked out well for my clients. You are welcome to call for a free consultation.
