Stepmother is Taking it ALL!
My Father was in possession of his own assests and the assests of my deceased mother. My Father died January 1, 2008. He left an irrevocable trust to his 2nd wife (My stepmother). Upon his death my stepmother has not provided any information or documentation (No will, copy of trust, etc.) to my father's son (me) or daughter. We have NO IDEA how to receive any part of the estate. Furthermore- my stepmother has put the house for sale and is planning to move to the east coast where she plans to build an addition onto her daughter's house. Can we challenge the trust? Can we sepeuna information? Can we freeze the estate assests pending further investigation? How can we keep our stepmother from taking and leaving with my Mother and Father's real property and assets?

Hire a lawyer to send a demand for a copy of the documents and an accounting. If it is not forthcoming, or if you suspect something fishy, file a lawsuit for an accounting.

You can file to open probate and be appointed as the personal representative of your father's estate. Your stepmother must be notified, and then you can subpoena the trust and will.
