Legal Question in Wills and Trusts in Utah

becoming a widow

my husbands health is starting to go downhill. the house and most of our assets are in his name only. If he should die with things the way they are will I automatically get the house, cars and access to his bank accounts? or do we need to make changes first?

You will have to go to probate, which is a slow and expensive process. There is away to avoid probate and expedite the transfer of your assets. Please call for a free consultation.

It depends on how everything is titled. If you hold everything as joint tenants, it goes to you automatically. If anything is held in his name alone, it will have to be probated (there are affidavits that can be used in some circumstances to avoid a full-blown probate). The biggest problem will arise if you pass away before him, even though you don't expect to. You really need to see an estate planning attorney to see what uyou want to accomplish and how to get there. Call me if you have further questions.
