Legal Question in Wills and Trusts in Utah
Widow rights
If a spouse quick claims property 2 years before his death to his children from a previous marriage; does the current wife (who has been married to him for 37 years) have any rights to their property? They have accumulated things during their marriage and also have a home they aquired while married. This home was in the deceased spouse's name and is now quick claimed to his children. What can the widow do?

Re: Widow rights
You must open probate and petition the court to enforce either the will or the intestate (dying without a will) provisions of the Utah Code. You should be able to prove that the quit claim was invalid because of your marital interest. This is a general answer, but more facts are needed to evaluate your claim. You may call for a free consultation.
