Whoever's name is on the account as beneficiary inherits 100% of the account. Everything else may be 50/50, but not this account. Beneficiary overrides anything else. The law is that your dad understood the consequences of putting your brother's name on the account and not both of your names, and your father intended to account to go to him 100%. That's the law.

Good luck.
