Legal Question in Bankruptcy in Vermont
Filed 4-5 years ago; debts discharged. Disabled; can I file again.
I filed for Chapter 7 bankruptcy, I believe in 1999, in the State of Oregon. My debts were all discharged. At the time, I was unemployed.
Currently, I am on disability for depression and anxiety.
Do I have to wait 6 years to file a Chapter 7 again? I can no longer afford to pay my debts on my limited income. I have tried to work over and over again, but it doesn't ever work out.

You would have to wait for the six year period to expire before you could file under chapter 7. However, a good attorney can use strategy to file for you under chapter 13. You would have to repay a portion of your debts and you would have to be in chapter 13 for a minimum of 3 years. Please feel free to call me personally to discuss your situation in more detail. ph.
