Legal Question in Criminal Law in Vermont
Criminal Proceedings
I have not been formally charged with anything as of yet. I am being accused of perjury, and falsifying information to police. However, during my initial questioning, the police never told me to have a lawyer present. I was never read my miranda rights before being arrested. I was forced to answer questions that I didn't want to, but thought cooperation was best. Is this a civil rights violation? I have a clean record.

As a Delaware criminal defense lawyer for 30 years, we have seen this issue arise many times.In a custodial interrogation setting Miranda rights MUST be read and explained to you, and if you invoke your right to silence or attorney, questioning must cease. Your statement should be suppressed by Judge and not allowed to be used v. you Edward C. Pankowski Jr.
