Beer Company Sponsoring Entertainment

I'm looking for someone to spell out the federal and state laws on beer companies sponsoring entertainment. I was told by the Vermont DLC to look at the Alcohol and Tobacco Tax and Trade Bureau under section 6.81 which lead me to the e-CFR Title 27 S 7.5-7.55. From what I read, there is no reason that a beer company can't sponsor an outdoor music festival as long as they comply witih 7.5-7.55. However, the Vermont DLC says that any money changing hands and resulting in advertising at a venue with a liqour license is promoting the sale of a beverage and is therefore considered a gift in exchange for advertising and promotion of a specific beer and is therefore illeagal. Is there anything I can do to make the DLC see this another way? Beer companies all over the country sponsor music festivals. Why is VT so tough? Thanks in advance.

Something sounds wrong here. If money changes hands on an arms-length basis, this would seem to deny an interpetation of "a gift." Hire local counsel and try contacting a local brewer to see if you're reading this correctly.

I don't practice in VT, but it sounds like you'll need to challenge the DLC's interpretation of their rules and the laws to make a change. An attorney can do that for you.
