Legal Question in Family Law in Vermont

guardianship

I am looking for information on how my husband and I can help children who are friends of ours to get out of a bad situation. They are 17 and 15 and we are looking into what it would take to become their guardians. I don't think the parents would do that willingly, but these children want to leave, more on the basis of neglect than abuse, although verbal abuse is quite frequent there. What can we do? The 15 year old is too young to be emancipated, and neither of them can pay for a lawyer as they already have to care for their own needs (food and clothing, etc). They also have a little brother (approx 10). The three of them are brothers, and they were adopted by a family with 3 other children.

Re: guardianship

It is almost impossible that in the presense of their own parent you may become their gurdian. however, you can apply to court under humman rights law provided you can substantiate that you can make children future brighter than thier natural guardian. Please note that appointing guardian, is totaly discreationary powers of Judge therefore he may allow you but most of such cases the court do not favour.
