Legal Question in Family Law in Vermont

Out-of-State Custody

My son-in-law and parents stole my granddaughter from my daughter. He is a convicted rapist in Vermont and his parents are alcoholics. Can I get my daughter and granddaughter from Vermont and bring them to Virginia? Since my daughter wants to do this, can I get into any trouble? My son-in-law cannot leave Vermont since he is on parole. I would like to do this as soon as possible.

Thank you.

Re: Out-of-State Custody

Without knowing the custody situation between your daughter and son-in-law, it is difficult to say. Is there any court order or separation agreement governing child custody and visitation? As for you physically removing the child from a parent's custody, that is not something you want to do. You could be charged with kidnapping for doing so. Your daughter should consult an attorney and present all the facts of her situation so that she knows her options for pursuing this matter in court.
