Legal Question in Family Law in Vermont

Ex refuses to pay for court ordered travel expense, will not return child

I have full physical custody of my 3 year old son and my ex husband has visitations with him every couple of months because we live in seperate states. (I live in Illinois, he lives in New York)

Upon going to court to modify visitations (In Vermont) it was so ordered that we both split travel costs and travel 50/50. He has my son on a visit now and my son is court ordered to be back in 10 days. My ex husband says that he cannot afford half of the travel expense, because it meant that I would cover round trip travel one time and he cover it the next time. I was depending on my ex splitting travel costs, but he refuses, so I cannot get my son back from his visit. What can I do about this to get my son back and what can I do in the future if this continues to be a problem?

Please help, I am at my wit's end and would like my son to be returned to me.

Thank you.

Re: Ex refuses to pay for court ordered travel expense, will not return child

You write that a Vermont court ordered the modification of visitation. Any legal proceedings concerning this matter would likely arise in Vermont and proceed under Vermont law. You should resubmit your inquiry to a Vermont attorney.

To the extent that you might be able to obtain relief in an Illinois court, you will need to see a lawyer, share the facts with him/her, and obtain his/her advice. I am confident there are many very skilled attorneys in your area who can meet your needs and advise you regarding modifying or enforcing of your visitation rights.
