If a husband and wife are being sued can the other side demand they be deposed seperately without the other present?

Is this in state court or federal court?

I don't know the laws of your state at all.

My guess at an answer: probably yes (the opposing

side can depose each spouse separately); with good

enough reason, a lawyer woudl get witness sequestration

in court and might be entitled to same upon depositions.

You'll probably use the same lawyer, though, won't you?

That's a good way to cross-check if the husband and wife

are colluding to lie. If you are, I would hope you get

caught. If you're not, unfortunately, you can still get

caught up in having what appears to be different stories

even though they really aren't.
