Legal Question in Health Care Law in Vermont
Scope of Health Care Records
What records kept by a health care provider may be excluded from, ''health care records'' that must be given to a patient upon request? Particularly, must a provider give a patient requesting his records minutes of internal agency meetings held to discuss staff complaints and problems related to providing care to the patient?

Re: Scope of Health Care Records
Generally speaking, a patient is entitled to all written or recorded communications regarding his care; however, there is an argument to be made that if records were taken in a meeting that included confidential records of other patients and that was not included in the patient's chart, that it may be excluded. I would need to know more information before answer more thoroughly -- is it patient seeking the records or his lawyer for litigation? What is it in particular that the patient is looking for? Sorry, there is not an easy clear cut answer -- that is the nature of health law, though.
