Legal Question in Wills and Trusts in Vermont

deeded encumbrances

My church was deeded a piece of property with a building in 1906.

The restriction on the deed was '' there shall be no dancing or card playing in the building or the property shall revert back to my heirs''.

You seee our dilemma. How should we approach this situation???

I am not sure if heirs still exist.

Consult a real estate attorney in your town. Such restrictive covenants are usually unenforceable under current law as being void and against public policy.
