Re: provisions of use, life estate property
Insufficient information provided. What kind of property?
How held (titled) as a life estate, or a joint
interest for children's benefit? In trust?
Passed under a previous estate? How used?
Is it a living arrangment for an heir, or used
to generate cash (clear cutting of forests)?
There are more complexities here than you can imagine.
Is this real estate (undeveloped land), a residence,
or business related property? Are their any restrictions
in the deed? Has there been a previous full/partial gift?
Who holds the life estate? What is your vested/unvested interest
currently? Who are the parties in possession? Is there a written
lease/or verbal understanding among the parties?
I suggest you consult an attorney nearby and get
a professional opinion from one who knows and
understands "future interests" (ask them if they
took the subject in law school and if they did, if
they passed.) Good luck.
