Legal Question in Wills and Trusts in Vermont

Rights of Dowry.

If a spouse was left out of a will, not on purpose, is she still entitled to all her late husbands possessions and all contents of his house, if it states in his will that it was all left to his children?

Re: Rights of Dowry.

If this is a Vermont estate I cannot answer the question. If the estate is in Maine, there is a complicated formula that must be applied, as the spouse has the right to retain the $10,000 Homestead allowance, plus certain exempt property, and then possibly $50,000 plus 1/2 of the remaining estate.

The specific facts will need to be determined to calculate the amount, so the effect may be that the spouse gets all of the possesions and furnishings, if they are valued below a certain amount.
