Back to Court?
I have been divorced for nearly 3 years. Since that time, my ex-wife has quit or been fired from approximately 8 jobs. She is threatening to take me back to court, because she doesn't feel like continuing in the work world. Does she have a legal right to do such a thing after all this time? I have since remarried and pay substantial child support monthly.

The courts are open to all who seek relief. Your ex may not be entitled to relief. You can recalculate your support obligation using the chart and information in Florida Statute 61.30. I would use her highest income amount in estimating her earnings.

Does she have a legal right to change jobs? Of course. Is she obligated to help pay child support? Of course. If she is ill or disabled, that may be considered by the court. If she is voluntarily unemployed, she can be required to pay support based on what income she would earn if she would work. You are advised to be represented by a local family law attorney if she attempts to modify the child support because she just doesn't want to work.
