Selling alcohol without a license-Operating a business without a license
What is the definition of the law section 4.1 - 302 - selling alcohol without a license? What is the law section and definition for operating a buisness without a license? If an undercover officer asks you for a beer, and you hand it to him with no charge or other conversation, is this distributing alcohol without a license? What about if this happens at a party that you are at, but you have nothing to do with any money being exchanged? What if you were there to have a good time, and you did't have anything to do with the party, and you don't even know the people who are having it? I was having a good time trying to meet people, and an undercover officer asked for a beer, and I handed it to him.

VA Definition of "sale" of alcohol
Va. Code Section 4.1-100 defines "sell" as "includes soliciting an order for; keeping, offering or exposing for sale; peddling, exchanging or bartering; or delivering otherwise than gratuitously, by any means, alcoholic beverages."
If there was no charge (including an admissionfee for the event offering free beer, which would arguably be a sale), and nothing requested in exchange, you should be found notguilty.

I agree with what Dan Press has published. Section 4.1-302 deals with the sale by persons or businesses not licensed for sale by the ABC people. It does not matter if the business failed to obtain a business license, which is for the local authorities to enforce. If there was no sale, trade, or attempt to gain business by offering the beer, you should have a successful defense.
