I am 20 year old male who lives in virginia. My girlfriend is a 17 year old who lives in california. Her dad lives in california. Can he charge me for rape?

Virginia still seems to make eighteen the age of consent, as provided in the following relevant portion of Va. Code � 8.2-371. "Any person 18 years of age or older, including the parent of any child, who ... engages in consensual sexual intercourse with a child 15 or older not his spouse, child, or grandchild, shall be guilty of a Class 1 misdemeanor."
By the way, it looks incongruous to exclude spouses and non-spouse relative in the same sentence, but I assume that harsher penalties are provided for the latter.
