SINCE THE VIRGINIA WORKERS' COMPENSATION ACT( SEE BELOW) STATES THAT "ANY PARTY MAY TAKE TESTIMONY OF ANY PERSON, INCLUDING A PARTY, BY DEPOSITION..

.DOES THE WORD "MAY" INDICATE THAT DEPOSITIONS ARE NOT ABSOLUTELY NECESSARY?

. DOES THE COMMISSION HAVE ANY JURISDICTION OVER DEPOSITIONS?

Below is a portion of the Virginia Workers� Compensation Act which relates to Discovery.

G. Depositions. After a claim or application has been filed, any party may take the

testimony of any person, including a party, by deposition upon oral examination or upon written

questions.

Depositions are generally allowed if they can lead to any relevant issue in the case. THe parties are mandatory and others you have to pay for their time- like a Dr depo.
