disability discrimination

i have a case number with the eeoc.

the vice president discriminated myselffor the open position in the maint. dept of the hotel i work in. he said it was decided on life safety issues. this was after i was offered the position and recieved the raise for that position. the general manager was the one offerd myself that job. so my question is if the vice president offered me the job after what has been said and done and i refused the position based on discrimination do i still have a case for violating my rights as an disabled employee? this whole situation has caused me stress and emotional damages. i have not loss any work because i can not afford to lose any pay. I am very agravated and stressed about this whole scenario and i need some legal help. i spoke with the rep. at the eeoc and she stated that i can not sue for discrimination because the vice president did try to resolve this matter, but she will see what she can do about the emotional distress in this case. now is she correct? is there anything i can do for my case? i do have witnesses and evidance for this case. please let me know asap!

You would appear well advised to await until the EEOC has been available to properly investigate all of your claims and then to follow their recommendations.
