In Virginia, the records of felony convictions are never expunged unless the defendant can prove that s/he was wrongfully convicted and, consequently, has received a pardon from the governor. However, the record of a first time misdemeanor offender may be expunged unless the Commonwealth can show "just cause" for opposing such expungement. (See Va. Code Sec. 19.2-392.2 et seq.).
