Legal Question in Disability Law in Virginia

Information required to obtain mortgage loan

Hi,

My spouse is trying to obtain a mortgage loan. He receives income for a disability. The mortgage broker has said that he needs a letter stating how long he will be on disability. My spouse's practitioner says that they can't give a letter with that information because nobody knows how long he will be on disability. Can the mortgage company deny a loan if they don't have this information? He has been receiving disability payments for about 10 years. The mortgage broker also told him that he needed to submit a letter stating what his disability is. After I questioned the validity of this request, the mortgage broker stated that we needed a letter indicating how long my husband would be on disability.

Thanks for your help.

Have a blessed day.

Re: Information required to obtain mortgage loan

If the questions being asked by the lender are reasonably related to the issue of the lender's potential risk in making a mortgage loan to your husband, then they are appropriate and cannot be fairly characterized as discriminatory.

It would appear(at least to me) that that is the case with these particular questions and if you

or your spouse find them objectionable, then you should look for another broker.
