If I married my husband in August 2007 but his divorce was not actually finalized until December 2007, is our marriage legal?

Va. Code Sec. 20-38.1 specifies:

(a) The following marriages are prohibited:

(1) A marriage entered into prior to the dissolution of an earlier marriage of one of the parties.

Va. Code 20-43. Bigamous marriages void.

All marrriages prohibited by law on account of one of the parties having a former wife or husband then living, shall be absolutely void without a decree of divorce or other legal process.
