Legal Question in Disability Law in Virginia

student debt

My husband and I are disabled. He is retired and received his Gov't. pension. I'm unable to work and don't even receive disability. The dept of education is suing us and taking our tax refunds. Can they attach my husband's pension?? This is all we have.

Virginia is not a community property law state, however, if your husband owes delinquent student loan(s) as well as you, then, yes, the Department of Education can very likely garnish a portion of his government pension as well as seizing your tax refunds.
