Legal Question in Disability Law in Virginia

Termination after being diagnosed with bipolar

My husband was terminated by his employer (A local city govt) 11 days after being provided with medical documentation of newly diagnosed Bipolar and Short Term Disability Paperwork, saying he took too much time off.

We submitted a complaint to the EEOC, who after some investigation served the ''city'' with the charges. A mediation has been sched for next month. The question is: should we retain an attorney for the mediation? And we have to submit the form of who will attend. I have been the primary communicator because any stress makes my husband worse. how do i list myself on the form to ensure i can speak on his behalf? Do we select the ''Special Needs/Accomodation needed'' box and say that i need to speak on his behalf due to the nature of his disability? (We were told that only the principal party could speak unless the opposing party agreed) or am i a principal as well being his spouse and having to care for him now?

thank you for any information.

Re: Termination after being diagnosed with bipolar

I would advise that you retain an attorney to represent your husband at this mediation scheduled under the auspices of the EEOC to ensure that your husband is fully and properly represented at this proceeding, representation which you as a lay person may not be able to provide.
