Legal Question in Appeals and Writs in Virginia
Getting charge off of me
Im 25 years old now, when I turned 18, I worked in a dept store, and got set up by a girl for stealing to make a long story short. i was scared to tell my parents or anyone so I went to court alone without a lwayer, and anyone else and the girl who was also fired the same day I was never showed up. I was given a charge of embezelment because the judge said the other party was not there, and he needed proof, however he didnt want to prolong the case. Since then I have went to school, got a nursing degree (RN), and now when I get a job in the nursing field they fire me becasue they say it was a felony but was reduced to a misdemeanor. I dont lie on my application, i do tell the truth about it. I have since found a job, and have been working there for the last 2 years. If i was able to become a notary, I would get promoted in my current job, but Im afraid to apply because of the charge. But my love and passion will always be nursing. How can I fix this? Is there anyway i can get it off of my record? Can this be expunged? I went to school to be a nurse, and want to work in that field. Please Please, any advice would be helpful.

Re: Getting charge off of me
The prohibition on becoming a notary only applies to those convicted of felonies and not misdemeanors, so you should be able to qualify with no problem.
And those folks who have no more than one misdemeanor conviction may now qualify for expungement of that record under Va. Code Sec. 19.2-392.2(F).
