Re: Child Support in VA

You petition the court that has responsibility for the order to lower the amount based upon a material change in circumstances which under the Virginia Child Support Guidelines

may lower the amount of your support order. The burden is on you to demonstrate to the court's satisfaction that in fact this material change in circumstances has

actually occurred. Merely wanting the amount of the support reduced because you've now got a higher car payment

or extra credit card bills to pay will not suffice. However, proof of an extra mouth or two to feed in your current family which you did not have when the support order at issue was entered or a showing of a substantial and sustained reduction in your gross monthly income would, nevertheless, very likely qualify as a material change in your circumstances which could persuade the court that a reduction in the amount of your current child support is warranted under these kinds of changed circumstances.
