Divorce debt paid

I had a debt to be paid from divorce agreement of 40.000.00

Over a 7 year period I have paid 44,940.00

I also waived my 25% of house ownership to cover any debt my ex paid to assist in making paynents. I believ my debt is paid and should no longer be required to make payments. How do I appeal to court?

You do not have to appeal. Appeals concern errors in law raised by parties that have been affected by a trial court's judgment or orders.

What you desire is a satisfaction of judgment. There is a statutory procedure to demand satisfaction of judgment, which is covered by Code of Civil Procedure section 724.050.

If the party who receives the demand for satisfaction of judgment fails to execute and deliver a satisfaction within 15 days, the party who serves the demand for satisfaction of judgment may file a motion with the court that issued the judgment to have the party execute the satisfaction of judgment.

The party demanding satisfaction of judgment has the burden of proving to the Court that the judgment was satisfied, including interest.
