Legal Question in Appeals and Writs in Virginia

False report

My son girlfriend put out a false report of domestic abuse in Maryland and a warrant was put out on my son without him knowing it, He went to Va and was arrested July 30th because of the warrant. He went before a judge and waived extradition 2 days later and suppose to be extradited back to Maryland. Virginia charged him for being a fugitive. The Virginia judge set a court date for September 24th. It is now 8 days and he is still locked up. No one is giving me any info of how long he is to be locked up. He is locked up over a false report. How long can they hold him in Virginia jail and how long does it take before Maryland pick him up and is it anyway I can bail him out.

Re: False report

Normally, a charging jurisdiction(such as Maryland in this case) would have around 72 hours to come and pick up a fugitive being held by the Commonwealth, and if for some reason that doesn't happen, the alleged fugitive is to be released.

There must be something else involved with your son's situation in Virginia as otherwise he should've been released

from Virginia's custody by now.

It would seem high time for you or your son to consult with a Virginia criminal defense counsel to find out what's going on.
