Legal Question in Appeals and Writs in Virginia
Reconsideration of Sentencing
Is there such an ''appeal'' as a reconsideration and is there a time frame it has to be filed? The conviction occured in 1/03. 3 years federal time and 5 yrs state time consecutive. It was for poss of firearm after being conv. of felony. He's done fed time, doing state time now. Wanted to have time run concurrent, but DA wouldn't go for it. Any suggestions or options?

Re: Reconsideration of Sentencing
No, it's not an appeal but a motion for reconsideration which would be filed with the same trial court which convicted the defendant. The attorney who repreresented the defendant in this matter in the state court would be the best person to contact for advice on this particular issue.
