Legal Question in Banking Law in Virginia
In 2006 I was a victim of identity theft. I filed a police report, submitted an affidavit and was cleared by the bank for identity theft. In July of 2009, I was called in and suspected of bank fraud and wire fraud and read my rights which I invoked by the same bank. After reviewing the evidence, it has been proven that the bank made numerous errors with my checking account. I lost over 6000 dollars as the account was established and deposits were posted from my employer since April 2005, and the bank states I did not have an acitve account until 2006 and denies . They stated I opened the account online and funded the account with an external bank account. After reviewing my bank statements from the account they identified, there was no such transaction. Is there anything I can do to file a counter suit against them?
