Legal Question in Bankruptcy in Virginia
I have an adversary proceeding going on in a chapter 7. The summons was issued on 09/23. Per the initial scheduling order i am supposed to have a discovery meeting with the plaintiff within 40 days. That time has passed. Can I file a motion to compel discover since the plaintiff has not contacted me or returned my calls to formulate the discovery plan?

If the summons was issued 9/23, you have until about 11/1 to do this. Your answer is due on 10/23. You SHOULD NOT even think of doing this without a lawyer.
