Legal Question in Bankruptcy in Virginia

Is this Right??

I attended a chap. 7 meeting with trustee, he sent a real estate person to my house since I had equity in it, and wanted to keep it. I just got a call that my house was going on the market, so I called my attorney. She says I have to refile chap. 13 and start all over again.

Why can't I just pay the difference, do I get charged another fee? I am on disability and had a beacon score of 740 before this.

Please just tell me if this is right or if I'm just being charged twice.

Thanks, Sky

If you want to keep the house, you can either work out a deal with the Ch. 7 trustee to pay him/her the equity in the house, or convert to a Ch. 13 if you can't come up with that much money. If you convert to a 13, your lawyer is entitled to be paid for his/her work in doing the 13.
