I am considering filing for

bankruptcy. I have recently gotten

married, less than a year ago, and

would like to know how this is going

to impact my wife's credit or if

getting married will prevent me from

filing bankruptcy. We do not have

any joint credit card accounts. I

have always paid my creditors on

time but my debt repayment is

becoming unmanageable, to make

minimum payments requires a full

paycheck. I currently owe around

$68,000. Will getting married

prevent me from filing for

bankruptcy?

Until 2005, the answer used to be a clear NO. Now, it is possible that if your spouse makes a lot of money, it could impact your right to file under Chapter 7 (on the other hand, getting married could also make it easier if she makes little or no money). You need to consult with competent bankruptcy counsel - in most cases, we have found that it will not have an impact, and there are strategies that can be employed to make it work for almost all cases.
