Legal Question in Bankruptcy in Virginia
chapter 13 bankruptcy
i have missed one month mortg. payment on my chapt. 13 direct payment to mortg. company. what can be done or will the trustee dismiss my case. i go for my confirmation hearing tomorrow and need to know what can be done to save my case from being dismissed.

You may be able to confirm the plan being behind less than a month, but if you can't stay current on both your mortgage payments and your plan payments, your case is doomed to failure either through the creditor getting relief from the automatic stay or the plan defaulting. If this is the first confirmation hearing, even if the court does not confirm your plan, chances are you will be given a chance to catch up.
