Legal Question in Bankruptcy in Virginia
Chapter 13 Bankruptcy
My parents are paying my student loans. I have now assumed responsibility for them since they are now unemployed. I am having to file Chapter 13. The creditor will not take the bill out of thier names. Can I still list this as a creditor for Chapter 13 and will they seek action against my parents? After all, it is my loan. Can the loan be discharged?

Re: Chapter 13 Bankruptcy
You can list the student loans on a 13. They are probably not dischargeable, but it depends on complicated factors that should be considered by a bankruptcy attorney. Whether you can discharge the loans or not, it appears your parents may remain obligated on the debts. It appears they agreed to pay them.
