Legal Question in Bankruptcy in Virginia
Chapter 13 Bankruptcy
Sir, I would like to know, for what reasons could
my Trustee change my Chapter 13 Bankruptcy period
from 36 months to 44 months. This change comes
after 30 months. Is this action within the Bankruptcy Laws?

Re: Chapter 13 Bankruptcy
It is most likely proper, but you would have to consult with your lawyer to be sure. The usual reason for this type of post-confirmation modification is that claims filed post-confirmation have resulted in the plan being insufficient to pay off all secured arrearages and priority debts, which must be paid in full for the plan to comply with the law and for you to receive a discharge.
