Legal Question in Bankruptcy in Virginia
Hi ...I am looking to file bankruptcy....I went through a divorce, we had our house foreclosed on and had tens of thousands in credit card debt...Divorce ruling was the debt was split in half...My question is if I file bankruptcy, I have no idea the exact amount I owe and who I owe...will an attorney still be able to help me file bankruptcy and how will they go about that? Thank You, Jamie...PS My house was in Florida but I am now a Virgina resident

You certainly can file bankruptcy, and between the divorce filings, your credit report, and your own records, you should be able (with the help of counsel) to figure out who your creditors are. Given the divorce decree which sounds like it requires you to pay debt that your ex-spouse may be liable on, it would probably be necessary to file Chapter 13 to discharge the indemnification liability to your former spouse, unless both of you file Chapter 7. You should consult with a bankruptcy lawyer to advise you in detail about your specific situation.
