Legal Question in Bankruptcy in Virginia
Filing Bankruptcy
I married in may 2008. My husband has decided to claim (personal) Chapter 7 bankruptcy. We each have our own debts. Do I have to be included because we are married?

Re: Filing Bankruptcy
No. Marriage (except in certain community property states, which do not include VA) does not affect liability for debts. However, your income does have to be considered for means testing purposes.
