Legal Question in Bankruptcy in Virginia
Grounds of Defense
I filed for bankruptcy in 2003, including a credit card that my husband is now being sued for. The Bill of Paticulars only includes a letter from the collection agency. He now has to submit a grounds of defense. The # is the same as was included in my papers. How do we fill out the form?

Your bankruptcy does not affect his liability on the claim. He needs to assert any defenses he may have without regard to the bankruptcy. He should consider retaining counsel to represent him if he thinks he might not owe this.
