Legal Question in Bankruptcy in Virginia
Our landlord filed ch 7 bankruptcy
She is losing both of her houses. What is the soonest we would have to move from the property we rent from her if the court date is April 4th, 2008? How can we find out if the new owners would be interested in keeping us as renters?

Re: Our landlord filed ch 7 bankruptcy
It depends how she is losing the houses and what the "court date" is. If the bankruptcy trustee is selling the house, you are not required to move out for the term of your lease, although the landlord/buyer can stop providing services (for which you can reduce your rent). If the houses are being foreclosed upon by the lender, then your lease and right to possesion end as of the foreclosure date, and the buyer can either decide to lease to you or require you to move out (which they can do as quickly as under a month, but often will let you take longer). If the "court date" is the meeting of creditors, that does not determine anything as to you. If the court date is an unlawful detainer filed in state court, then you would have only a couple/few weeks.
