Leaglly Separated and Bankruptcy
I am originally from the Texas area and have been living in Virginia for over 2 years since I have separated from my husband. We have not divorced legally but I am planning to file for Bankruptcy beacuse a credit card which my husband has used under mine and his name have not been paid. The collector's are going to garnish my wages soon and I have 2 kids I have to support. Can I file a bankruptcy separately and will that stop the collectors from garnishing my wages? Do I have to legally file for a divorce before filing for bankruptcy? PLEASE HELP...

Yes, you can file bankruptcy separately and that will stop all garnishments. You do not have to be legally separated or divorced to file bankruptcy separately. You should consult with a local bankruptcy attorney, ASAP.
