Can you file bankruptcy more than once? If yes, how many years do you have to wait?

You can file and receive a discharge under chapter 7 every six years from the prior discharge. Chapter 13 option is available if you have not reached the 6 year mark. Please consult an attorney such as myself to review the matter.

You cannot get a discharge in a Chapter 7 bankruptcy more than once in six (6) years. However, if you recived a discharge within the last six (6) years, you may still be eligible to file a Chapter 13 bankruptcy and receive a discharge in that case.
