Legal Question in Bankruptcy in Virginia

re:Bankruptcy

I am contacting you for a friend whom is considering bankruptcy. He is married and is legally seperated and filing for divorce through legal aid. His ex is stating in order for her to file bankruptcy they need his signature. Is this correct? Or how will this effect him? Should he file bankruptcy with her, or seperate? Or does it matter?

Re: re:Bankruptcy

They can file together or separately. If filing separately, they don't need to sign each other's petitions. They each need to speak to separate counsel familiar with the implications of divorce and bankruptcy to decide which is best for them.
