Legal Question in Bankruptcy in Virginia

Is Suing a bankrupt person worth it?

I believe I have grounds for suing a person for fraud who was recently discharged in a Chap 7 no asset bankruptcy. Would it be worth the trouble since they have no assets?

Re: Is Suing a bankrupt person worth it?

If they were already discharged, you had notice of the bankruptcy, and your claim arose before the case was filed, your claim is discharged. Otherwise, if it is not discharged, you need to determine whether they have sufficient assets or income, or the likelihood of having them in the future, to make litigation worthwhile.
