summons for garnishment

i am suppose to appear in court on october 5, 2007 for garnishment. do i still have to appear even if i am filing for bankruptcy on october the 12th?

Yes. You cannot avoid a court appearance when summoned. Once you file for bankruptcy, it is advisable to have a suggestion of bankruptcy filed in any other actions in which you are a party. If you are summoned as a witness, the automatic stay does not allow you to avoid a court appearance - just protecton against collection activity.
