Legal Question in Bankruptcy in Virginia

My tenant who has not paid me, has been served a 5 day notice and a summons for unlawful detainer because the tenant has not responded nor vacated,. the court day is set for 5/18, can the tenant file for bankruptcy ?

My tenant who has not paid me, has been served a 5 day notice Subject to limited exceptions, anyone can file for bankruptcy at any time. It's part of the privlege of citizenship.
