Legal Question in Bankruptcy in Virginia
wife wants to file for Chapter 11, husband pays his bills
Due to credit card debt, my wife can no longer pay the minimums - she wants to file for Chapter 13 - I pay all the household accounts and my credit cards, and am solvent. How will this affect her if she files for Chapter 13 - the mobile home has lost it's equity in the downturn.

Re: wife wants to file for Chapter 11, husband pays his bills
She should be able to file without impacting you, but in a chapter 13, your disposable income (if any) is expected to help fund her plan. She should consult with an experienced bankruptcy lawyer to go over her specific situation. We practice bankruptcty law throughout Virginia and would be glad to discuss this matter with you and/or her further.
