Legal Question in Business Law in Virginia
In 2008 my wife worked as a secretary and driver for small masonry company. She bought a new car and the owner said he would pay for half so they were co-owners on the lease. After 3 months they were not making payment so the title was transfered to my wife. Now the State of Virginia is saying we are liable for the company's unpaid business, liscense fee and their taxes of furnitures and fixtures. They say that she is liable unless we can prove she was not an owner of the company. How do we prove this? Would her W2 showing she received a salary or her federal and state tax filings prove this?

Submitting a notarized statement from the owner attesting to your wife's status as an employee of this company during the relevant time periods plus a copy of her W-2 would seem like a good place to start.(Also, if the company was
registered with the State Corporation Commission, this agency should also have
a record of who the owner was.)
